Please read and understand the following carefully, this agreement is a contract between you and the owner of www. Yoybuy.com (hereinafter referred to as ” Yoybuy”) in relation to the Yoybuy PLUS CARD. The Agreement constitutes a legal document binding on both parties upon purchase of the Card.
Art.1 Definitions
1.1 Yoybuy PLUS CARD: Yoybuy PLUS CARD is a premium membership service for Yoybuy customers, which makes cross-border shopping more convenient by providing high quality customer service.
1.2 Yoybuy PLUS CARD Activity Period: All Yoybuy users could purchase a monthly card (valid for 30 days), a quarterly card (valid for 90 days), or an annual card (valid for 365 days) according to your needs. After the purchase, you could enjoy the services provided by Yoybuy.
1.3 Auto-Renewal Service: If you have purchased the auto-renewal version of PLUS CARD, according to your authorisation, after your PLUS CARD expires, the system will automatically initiate a debit order to your Yoybuy account balance, please ensure that you have sufficient balance in your account.The price of Yoybuy PLUS CARD may be adjusted. The latest price will be effective from the date of announcement, the PLUS CARD you have opened before the effective date will not be affected, if you need to renew the PLUS CARD after the expiry date, you will pay according to the price standard that has been effective after the adjustment.
Art. 2 Acknowledgement and Acceptance of the Terms of Yoybuy PLUS CARD
2.1 The Yoybuy PLUS CARD campaign is owned and operated by Yoybuy.
2.2 By purchasing PLUS CARD, you are deemed to have agreed to accept the terms and conditions of the Yoybuy PLUS CARD and to perform in accordance with the contents of this agreement. If there is any liability associated with you, you agree to bear the corresponding legal responsibility.
2.3 You agree and understand that if you have purchased your PLUS CARD as an annual/quarterly/monthly card and have enabled the auto-renewal service, your PLUS CARD will be automatically extended for one year/quarter/month after the expiry date. Under the above circumstances, you authorise Yoybuy to automatically deduct the PLUS CARD fee for one year/quarter/month from your account balance.
2.4 Yoybuy PLUS CARD does not support refund after opening card.
①Purchase an auto-renewable monthly/quarterly/yearly card, the second month/quarter/year will be automatically deducted from your account balance;
②Purchase an auto-renewable monthly/quarterly/yearly card, if you want to cancel the auto-renewal function, please go to the bottom of the membership card interface and click – Cancel Auto-Renewal. After cancellation of auto-renewal, if you need to purchase the card again, you have to purchase the card at the original price and no longer enjoy the discount;
③If your account balance is insufficient, the service will be terminated automatically after the expiry of the PLUS CARD, and the card will be purchased at the original price again.
Art. 3 User Rights and Benefits
The rights and benefits you could enjoy after purchasing PLUS CARD are subject to the information published on the official website of Yoybuy. In order to provide better services to you, Yoybuy has the right to adjust all or part of the user rights and benefits based on its own business development needs. Yoybuy will notify or announce the adjustment of the above benefits on the corresponding service page, and you could check the latest user benefits through the official website of Yoybuy.
Art. 4 Precautions for Users
4.1 After the opening of Yoybuy PLUS CARD, users should be prudent and reasonable to save and use the account information, and shall not lend the account obtained by registering on this site to others, otherwise users shall bear all the responsibilities arising therefrom, and at the same time, Yoybuy shall have the right to make an independent judgement in such cases, and may take measures such as suspending or closing down the eligibility of the user’s participation.
4.2 The User agrees that Yoybuy has the right to send you necessary information such as event information via email, WhatsApp, etc.
4.3 Yoybuy reserves the right to close your PLUS CARD, cancel or suspend all or part of your PLUS CARD rights and benefits, and not to refund or replace the fees you paid, if the PLUS CARD user commits any of the following acts, including, but not limited to, the following acts. From the perspective of fairness and reasonableness, you should be aware that you are solely responsible for all the consequences or losses arising from all the operations realised through this account.
① Use the PLUS CARD for profit or illegal gain;
②Assigning or transferring PLUS CARD or benefits in any form;
③Lending PLUS CARD or benefits to others, placing orders on behalf of others;
④ Purchasing PLUS CARD through any improper means, such as maliciously bypassing the normal opening process;
⑤ When using PLUS CARD, the user has the behaviour of disrupting the trading order and violating the trading rules by using tools such as secateurs and other tools to place orders, taking advantage of discount spreads, placing false orders for transactions, providing false trading information, and so on;
Art. 5 Updates to the Agreement and the User’s Obligation of Care
According to the changes in national laws and regulations and the operational needs of the website, Yoybuy has the right to formulate and modify this Agreement and/or the related service rules from time to time by means of website announcements, suspend, cancel and modify the terms of this Agreement, and the modified Agreement will take effect once it is announced on this website and replace the original Agreement. Users should pay attention to the service rules issued from time to time and changes to this Agreement. If you do not agree with the relevant rules and terms of modification, you should contact Yoybuy in a timely manner. If the user continues to use the services provided by this website, it is deemed to agree to the updated agreement. Yoybuy recommends that you read this agreement and the announcement of the site before using the site.
Art. 6 Others
6.1 The owner of Yoybuy website refers to the main business entity of Yoybuy website which is licensed or filed by the governmental departments according to law.
6.2 If the services of the website activities cannot be provided in time or in accordance with this Agreement due to force majeure or other reasons beyond the control of the website, Yoybuy will reasonably endeavour to assist in dealing with the aftermath.
